Balfour Beatty Recruitment Process Privacy Statement
Balfour Beatty plc, its group companies and joint venture entities and/or partners (together the “Balfour Beatty Group” or "we" or "us") will use the personal data we obtain from you in accordance with this Recruitment Process Privacy Statement (“Privacy Statement”) and our corporate group website privacy notice at: https://www.balfourbeatty.com/services/privacy/ (“Group Privacy Notice”) as part of our recruitment process to assess the role you’re applying for and keep you updated about the recruitment process. This Privacy Statement should be read in conjunction with our Group Privacy Notice.
Balfour Beatty plc is a “Controller” under the Data Protection Act 2018 and General Data Protection Regulation (EU 2016/679) (“Data Protection Laws”).
Personal Data Processed
Personal data is information which identifies or which could identify with other information held or available a living individual.
When you apply for a role or register your interest in careers with us we will collect your personal data such as:
- first name, last name, middle name, personal contact telephone number, email and postal address.
- employment details such as: employment history, length of service, qualifications, curriculum vitae information provided by you, current salary and salary expectations, notice period, redundancy status,
- Driving licence and Armed Forces status.
Please note: your employment details and curriculum vitae information may include ‘special categories of personal data’ as defined under the Data Protection Laws where you have chosen to include this, such as, for example information relating to your race and ethnicity, trade union membership, a disability or mental health.
Right to Work & Criminal Record Information
As part of the application and recruitment process we will also require:
- information regarding your right to work, passport copy or documentation for identification and right to work verification purposes and
- confirmation on whether you have or do not have any unspent criminal record convictions or at employment offer stage for specific roles, criminal record data in relation to Disclosure Barring Service (DBS) and other criminal record screening checks,
any criminal record data will be processed in accordance with our criminal record processing policy (available on request).
Diversity & Social Mobility Information
The application and recruitment process also includes personal data fields as below. These are requested on an optional basis for the pre-employment recruitment phase:
- diversity information such as race, ethnicity, disability and sexual orientation
- age banding and date of birth
- religion
- gender
- marital status
- nationality
social mobility information, if applicable such as social class, family background, geography and earnings
It is our policy not to discriminate against any applicant. The provision by you of the above diversity and/or social mobility information is entirely optional, there is no obligation on you as an applicant to provide this and we will not use this in the recruitment and selection process. If you opt to provide diversity and/or social mobility information as above this information is gathered solely for diversity and social mobility monitoring and reporting purposes. Any reporting of such diversity or social mobility information shall only be carried out on an anonymised basis. If you are successful in a role you have applied for, you may be required to provide some of the types of information above on the basis that it is necessary for your employment, a legal obligation or rights or obligations under employment law.
Use Made of Personal Data
We will process the above personal data for the following specified purposes:
- To enable our Resourcing team to contact you and help to determine your suitability for the role(s);
- To share your CV and application information with our employees with a need to access such information (e.g. hiring managers and team members within the shared service centre) for recruitment review purposes;
- To administer reporting on diversity and social mobility statistics;
- To transfer or share your personal data within the Balfour Beatty Group and with our third-party joint venture partner entities where necessary for the purposes of the recruitment review process;
- To transfer or share your personal data with the following categories of recipients:
- IT Service providers including role application tracking system providers, recruitment portal and candidate relation management (CRM) system providers whereby candidate information is stored on the Balfour Beatty talent community with our nominated CRM platform to enable applicants to hear about other job opportunities and/or the latest updates from us;
- recruitment agencies/ or recruitment service providers,
“Specified Purposes”
Legal Basis for Processing: Balfour Beatty is committed to compliance with the Data Protection Laws. Data Protection Laws require we meet certain conditions before using your personal data as set out in this Privacy Statement.
Criminal Records Data: We only process criminal conviction data in accordance with our Criminal Record Processing Policy (available on request) and where necessary for: (i) performance of an employment contract, (ii) compliance with a legal obligation and: (a) for carrying out obligations and exercising rights under employment and social security law, (b) for establishment, exercise or defence of legal claims, (c) for personal data manifestly made public by you or (d) to comply with a regulatory requirement to establish whether an applicant has committed an unlawful act or been involved in dishonesty, malpractice or improper conduct if consent cannot reasonably be relied on.
Diversity & Inclusion and Social Mobility Data: In relation to any personal data or ‘special categories of personal data’ provided by you in relation to the diversity and inclusion and/or social mobility questionnaires (“Diversity, Inclusion & Social Mobility Data”) for the purposes set out in this Privacy Statement we will only process such data that you choose to submit during the recruitment process where permitted under the lawful basis under Article 6(a) of the GDPR i.e. where you have provided explicit consent for us to process such personal data for a specific purposes and under the processing condition in Article 9(2)(a) of the GDPR i.e. you have given explicit consent to such processing for one or more of the specified purposes set out in this Privacy Statement in each case by clicking ‘Yes’ to the consent form set out below.
Right to Object or to Withdraw Consent to Processing
If you do not consent to us processing the Diversity, Inclusion & Social Mobility Data you have provided in relation to the diversity pursuant to this Privacy Statement you must notify us for management of consent withdrawals or objection submissions] and we will cease processing your personal data. Please note: if you withdraw consent or object to the processing of your personal data for the purposes set out under this Privacy Statement we will not be able to continue processing any application you may have made for a role.
Third Parties
When you give us personal data about a third party e.g. your spouse or children, you confirm that they have appointed you to act for them, that you have a valid legal basis for providing their personal data and that they agree to the processing of their personal data by us and that you have informed them of our identity and the purposes (as set out above) for which their personal data will be processed.
Where We Store Your Personal Data
We will only store your personal data for as long as necessary for us to process such personal data for the purposes set out in this Privacy Statement and will store your personal data for a retention period of 12 (twelve) month from the date of your application unless you request for your data to be removed sooner and as otherwise specified in accordance with our internal retention policies and procedures (as updated, and available at: https://www.balfourbeatty.com/media/317451/hrs-pl-0043-records-management.pdf).
